TERMS AND CONDITIONS
- Purpose of Agreement
The Buyer understands and agrees that the puppy is being sold as a companion pet and is not intended for breeding purposes unless otherwise stated in a separate written agreement signed by both parties.
- Spay/Neuter Requirement
The Buyer agrees to have the puppy spayed or neutered by a licensed veterinarian no later than twelve (12) months from the date of purchase. Failure to comply with the agreed terms will result in the puppy being returned to the Breeder.
- Proof of Spay/Neuter
The Buyer agrees to provide LouieYorkieCrustables with proof that the puppy has been spayed or neutered within fourteen (14) days of the procedure.
Acceptable proof includes:
- Veterinary certificate confirming the procedure.
- Veterinary invoice identifying the dog and confirming the surgery.
- Official veterinary records showing the procedure was completed.
Proof shall be submitted to LouieYorkieCrustables by email, mail, or another method approved by the Seller.
- Medical Exemption
The health and well-being of the puppy shall always take priority.
If a licensed veterinarian determines that spaying or neutering would pose a significant medical risk to the dog due to its size, weight, age, health condition, genetic concerns, anesthesia risk, illness, injury, or any other medical complication, the spay/neuter requirement may be waived.
To qualify for this exemption, the Buyer must provide LouieYorkieCrustables with a written statement from a licensed veterinarian explaining why the procedure is not recommended or would be unsafe for the dog.
Upon receipt of satisfactory veterinary documentation, the dog shall be exempt from the spay/neuter requirement for as long as the condition exists. If the veterinarian indicates that the condition is temporary, the Buyer agrees to comply with any revised timeline recommended by the veterinarian.
- Default, Repossession, and Return of Dog
The Buyer acknowledges that the spay/neuter requirement contained in this Agreement is a material condition of the sale and transfer of the dog.
The Buyer agrees to provide proof of spay or neuter, or an approved veterinary exemption, no later than one (1) year from the date of purchase.
Failure to provide such proof within the required time period shall constitute a material default of this Agreement. Upon default, LouieYorkieCrustables shall have the right to declare this Agreement breached and demand the immediate return of the dog.
The Buyer agrees to surrender the dog to LouieYorkieCrustables within fourteen (14) calendar days of written notice of default. The Buyer shall be responsible for all transportation and return costs associated with returning the dog.
The Buyer agrees that ownership rights to the dog may be forfeited upon failure to comply with this Agreement and upon written demand by LouieYorkieCrustables. The Buyer further agrees not to transfer, sell, breed, rehome, or otherwise dispose of the dog while any default under this Agreement remains unresolved.
The parties acknowledge that, under Virginia law, dogs are considered personal property, and the Seller may pursue all remedies available under Virginia law to recover possession of the dog in the event of a breach of this Agreement. Any return of the dog under this provision shall not obligate LouieYorkieCrustables to refund the purchase price, deposits, veterinary expenses, transportation costs, or any other expenses incurred by the Buyer unless otherwise agreed in writing by the Seller.
Attorney's Fees
In any legal action arising from the enforcement of this Agreement, the prevailing party shall be entitled to recover reasonable attorney's fees, court costs, and expenses as permitted by Virginia law.
- No Breeding Rights
The Buyer agrees not to intentionally breed the dog unless separate written breeding rights have been granted by LouieYorkieCrustables.
- Entire Agreement
This Agreement represents the entire understanding between the parties regarding the spay/neuter requirements for the dog described herein. Any modifications must be in writing and signed by both parties.
- Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia.
Any legal action arising from this Agreement shall be brought in a court of competent jurisdiction within the Commonwealth of Virginia.
